General Terms and Conditions

These General Terms and Conditions apply to all contracts between Maria Ehnert, [email protected] (hereinafter referred to as “Photographer”) and the client for private outdoor photo shoots booked via the website or by other means of distance communication.
1. Scope
These Terms and Conditions apply to the booking and performance of private outdoor photo shoots for consumers and customers in Germany. Deviating conditions of the client shall only apply if expressly agreed in writing.
2. Conclusion of Contract
The presentation of services on the website does not constitute a legally binding offer, but an invitation to submit a booking request. A contract is concluded only when the Photographer confirms the booking in text form, for example by email, or expressly accepts the booking.
3. Services
The scope of services is determined by the individual booking, package description, and booking confirmation. Unless otherwise agreed, the booking covers only the agreed photo shoot and the delivery of the agreed edited images. Raw files are not owed unless expressly agreed.
4. Prices and Payment
All prices are final prices in euros. A deposit of 30% of the total package price is due upon booking to secure the agreed date. The remaining balance is due no later than 7 days before the shoot date, unless otherwise agreed in writing. If payment is not made on time, the Photographer may refuse performance or cancel the booking after prior reminder and a reasonable deadline.
5. No Statutory Right of Withdrawal
Bookings for private outdoor photo shoots are contracts for services related to leisure activities with a specific date or period of performance. Therefore, there is no statutory right of withdrawal pursuant to § 312g Abs. 2 Nr. 9 BGB.
6. Cancellation by the Client
If the client cancels the booking, the following cancellation terms apply:
• More than 14 days before the shoot date: the deposit of 30% remains payable or non-refundable.
• 7 to 14 days before the shoot date: 50% of the total package price is due.
• Less than 7 days before the shoot date or in case of no-show: 100% of the total package price is due.
The client is free to prove that no damage or significantly less damage was incurred.
7. Rescheduling
One rescheduling request is possible free of charge if made at least 7 days before the agreed shoot date, subject to availability. For later rescheduling requests, a fee of €50 may be charged. There is no entitlement to a specific alternative date.
8. Cancellation by the Photographer
If the Photographer is unable to perform the service due to illness, force majeure, unsafe weather conditions, or other circumstances beyond reasonable control, the Photographer may cancel or reschedule the appointment. In such a case, the client may choose between an alternative date or a full refund of payments already made. Further claims are excluded except in cases of intent or gross negligence.
9. Weather Conditions
As the service is performed outdoors, weather conditions may affect the shoot. If severe weather or unsafe conditions make the shoot unreasonable or impossible, the Photographer and the client shall agree on a new date. If no reasonable replacement date can be found, payments already made will be refunded in full.
10. Client Obligations
The client is responsible for arriving on time at the agreed location and for providing all information necessary for the performance of the shoot. Delays caused by the client may reduce the actual shooting time. If the client arrives significantly late, the Photographer may shorten the session accordingly or treat the appointment as cancelled, depending on the circumstances.
11. Delivery and Image Selection
The Photographer selects and edits the images at their own artistic discretion. The client has no claim to the release of all images taken, unedited files, or raw files, unless expressly agreed otherwise. Delivery times are approximately 5-10 days after the shoot, unless otherwise agreed.
12. Copyright and Usage Rights
The Photographer remains the author and copyright holder of all photographs. The client receives a simple, non-transferable right to use the delivered images for private, non-commercial purposes, unless otherwise agreed in writing. Commercial use, sale, editing beyond normal cropping or formatting, transfer to third parties, or publication for business or advertising purposes requires the prior written consent of the Photographer.
13. Consent to Publication by the Photographer
The Photographer may only publish or publicly display images of identifiable clients with their prior express consent. Consent to publication, especially for website, portfolio, or social media use, is voluntary and should be granted separately. If the client cannot be identified in the image, the photographer has the right to publish her photographs without asking the client's approval.. Refusal of such consent does not affect the booking or the agreed price. For shoots involving minors, publication requires the consent of all necessary legal guardians.
14. Liability
The Photographer is liable without limitation for intent and gross negligence, as well as for injury to life, body, or health. In cases of slight negligence, the Photographer is only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. Liability for loss of profit, indirect damage, or consequential damage is excluded to the extent permitted by law.
15. Data Protection
Personal data is processed solely for the purpose of contract initiation, performance, communication, invoicing, and delivery of images, in accordance with applicable data protection law. Further information can be found in the Privacy Policy on this website.
16. Final Provisions
German law applies. If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected. Mandatory consumer protection provisions remain unaffected.
